What is CAA

  What is CAA ? Citizenship Amendment Act has been notified by the Centre i.e. ministry of home affairs and passed in 2019.

CAA notification came weeks after the Honourable  Home Minister Amit shah said that the rules for the law which recently passed in 2019 & would be implemented before the  Lok Sabha elections  & has passed on 11th of march ,2024.

The CAA helps & make it easier for the persons those are Non -Muslims who migrates from the Neighbouring muslim countries such as Bangladesh, Pakistan & Afghanistan to get Indian Citizenship.

As the union Home Minister Amit Shah announced that the law will be applicable to all those migrants who arrived in India on and before December 31,2014.

What  CAA Means?

The Citizenship Amendment Act (CAA) amends the citizenship act of 1955 to provide the path to the Indian Citizenship  to all those Hindus, Sikhs, Buddhists, Muslims, Jains, Christians, Parsis . All these minorities who migrated from the neighbouring muslim countries such as Bangladesh, Pakistan, Afghanistan on or before December  31,2014.

Under the amendment that passed in  the year 2019, Migrants who have entered India till 31 dec,2014 and has suffered  “Religious persecution or fear” in their Country of origin would be made eligible for accelerated citizenship.

Anti CAA protests: Timeline of Events happened across the Country.

 

  • CAA(Citizenship Amendment Act ) has been passed by the Parliament on December 11,2019  and notified on 12th of December same year but not implemented as rules regarding the law has not been decided by the centre at that time.
  • Later on , After 4 years as the news coming out by various reports that  the union Home Minister Mr. Amit Shah  would notify the rules regarding CAA before the Lok Sabha Elections of 2024, tentatively scheduled for April-May 2024.
  • According to the reports of Ministry of Home Affairs for the year 2021-2022 i.e. from 1 April to 31 December 2021 total 1414 Foreigners belonging to these non – muslim minority community from neighbouring muslim countries such as Bangladesh, Pakistan & Afghanistan were given Indian Citizenship under the Citizenship Act,1955.
  • From December 2019 to February 2020 there was a wave of Anti  CAA  Protests across the country which led to the Northeast Delhi riots.
What is CAA RULES: ELIGIBILTY, PROCEDURE, LANGUAGE REQUIREMENT
  • After the law was passed in 2019 , Home Minister held meeting regularly with the specified committees  for finalizing the rules for eligible persons to submit application for Citizenship under the CAA act.
  • The centre notified rules on 11th of march, 2024 as Home Minister Amit Shah promises the rules regarding the CAA  will come before 2024 Lok Sabha elections.
  • According to the rules: The entire procedure to submit the applications regarding Indian citizenship under the CAA will be online for all the Eligble persons  with some documents as notified.

IS CAA AGAINST ARTICLE 14?

 

   As Oppostion claims that CAA is Uncostitutional , regarding this our senior BJP Leader said that they always talk about Article 14. They forgot that there are 2 clauses in that article , this law doesn’t violates Article 14.


 WHY IS CAA IMPORTANT?

Just Before Lok Sabha Polls, The Ministry of Home Affairs notified that the citizenship amendment act (CAA) enabling Minorities facing ‘Religious Persecution or fear’ in Neighbouring muslim countries such as Pakistan, Bangladesh &  Afghanistan to obtain Indian  Citizenship  under Citizenship Amendment Act.
